These Terms and Conditions govern the use of the ProCharge website, accessible at https://procharge.in, along with all related services including the mobile application, EV charging infrastructure, and associated services. By accessing or using our platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using ProCharge services.

1. Introduction

These Terms apply to all users accessing or using ProCharge services, including website visitors, mobile app users, EV drivers, and partners.

  • “User”, “You”, “Your” refers to any individual or entity using the platform
  • “ProCharge”, “We”, “Our”, “Us” refers to ProCharge and its services


These Terms, along with our Privacy Policy and other policies, constitute a legally binding agreement between you and ProCharge.

2. Use of Website & Services

By using ProCharge, you agree to:

  • Not engage in any activity that may harm, disrupt, or overload the platform

  • Charging speed and performance may vary based on vehicle compatibility and technical conditions
  • ProCharge operates on a best-effort basis and does not guarantee uninterrupted service
  • We may perform maintenance, updates, or upgrades that may temporarily affect service availability
 

5. Payments & Transactions

All payments made through ProCharge are handled via secure third-party payment gateways.

  • Users must pay applicable charges for charging sessions, subscriptions, or services
  • Pricing may vary based on location, electricity cost, and service provider
  • Failure to complete payments may result in suspension or termination of services
  • Refunds, if applicable, will be processed as per our Refund Policy
 

6. Location Services

ProCharge uses location data to enhance user experience.

  • To display nearby charging stations
  • To provide navigation and availability updates
 

Users can enable or disable location access through device settings. Disabling location services may limit certain functionalities.

7. Intellectual Property

All intellectual property rights related to ProCharge are protected.

  • Includes branding, logos, software, UI design, content, and technology
  • Users are not permitted to copy, reproduce, distribute, or modify any content without prior written consent
  • Unauthorized use may result in legal action
 

8. Third-Party Services

ProCharge integrates third-party services to improve functionality, including:

  • Payment gateways
  • Mapping and navigation services
  • Analytics and tracking tools
 

These services operate under their own terms and privacy policies. ProCharge is not responsible for third-party service performance or issues.

9. Limitation of Liability

To the maximum extent permitted by applicable law, ProCharge shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to the use of its services. This includes, but is not limited to: 

  • Service interruptions, downtime, or platform unavailability
  • Charging failures, delays, or incompatibility issues between vehicles and charging stations
  • Loss of data, business opportunities, revenue, or profits
  • Errors, inaccuracies, or omissions in service information
  • Any damages resulting from reliance on the platform or third-party integrations
ProCharge does not guarantee uninterrupted, error-free, or completely secure services. All services are provided on a “best-effort” and “as-is” basis, without warranties of any kind, either express or implied.

10. User Responsibilities

By using ProCharge services, users agree to act responsibly and in compliance with all applicable laws and safety standards. Users must:
  • Use EV charging stations safely and only for their intended purpose
  • Avoid damaging, tampering with, or misusing any charging equipment or infrastructure
  • Follow all safety instructions, signage, and operational guidelines at charging locations
  • Ensure proper handling of charging cables and connectors
  • Promptly report any faults, malfunctions, or safety concerns
  • Provide accurate information during account creation and usage
  • Refrain from engaging in fraudulent, abusive, or illegal activities
Any violation of these responsibilities may result in penalties, suspension of services, termination of accounts, or legal action where applicable.

11. Suspension & Termination

ProCharge reserves the right, at its sole discretion, to suspend, restrict, or terminate access to its services without prior notice under the following circumstances:

  • Violation of these Terms and Conditions
  • Failure to complete payments or outstanding dues
  • Detection of fraudulent, abusive, or suspicious activity
  • Misuse or damage to EV charging infrastructure or platform services
  • Any activity that may pose a risk to other users, partners, or the platform

In serious cases, termination may occur immediately and without prior notice. ProCharge shall not be liable for any loss resulting from such suspension or termination. Users may also discontinue use of the services at any time by ceasing access to the platform.
